Status and scope
These Terms of Use are a draft for legal review. Legal entity information, governing law, jurisdiction, and final contact details must be confirmed before production use.
These terms apply to the public EvalTrack website. By using the website, a visitor agrees to use it lawfully and consistently with these terms. If the final terms are not acceptable, the visitor should stop using the website.
Website purpose
The website provides general information about EvalTrack, its connected examination-record approach, product views, institutional pilot, and public pricing. Website content is informational and does not by itself create an institutional service, procurement, implementation, or data-processing agreement.
Intellectual property
The EvalTrack name, logo, website design, written content, product presentation, and other materials are owned by EvalTrack or used with permission, except where another owner is identified. Rights not expressly granted in these terms are reserved.
Visitors may view the website and make a limited copy for their own internal evaluation of EvalTrack. They may not reproduce, republish, sell, license, remove ownership notices from, or create misleading derivative presentations of the website materials without permission or another lawful basis.
Acceptable use
Visitors must not knowingly:
- use the website unlawfully, fraudulently, or to infringe another person’s rights;
- attempt to disrupt, damage, overload, probe, or bypass protections applied to the website;
- introduce malicious code or use automated activity that materially interferes with the site;
- misrepresent an association with EvalTrack or an institution; or
- use website content to create deceptive or unauthorized representations of the product.
Third-party links and services
The website may eventually link to services or websites operated by others. Those services are governed by their own terms and privacy practices. A link does not by itself mean that EvalTrack endorses every statement, product, or practice of the third party.
Institutional arrangements
A pilot, subscription, implementation, integration, data migration, support arrangement, or processing of institutional examination data requires separate written terms. Public pricing describes the core platform offering; custom integrations and specialized implementation are scoped separately.
Nothing on this website promises unlimited customization, unlimited support, or a particular implementation result. The scope, responsibilities, timing, and data arrangements for an institution must be recorded in the applicable agreement.
Disclaimers
EvalTrack aims to keep the public website useful and accurate, but the website may contain errors or become temporarily unavailable. To the extent permitted by applicable law, the website is provided without an unconditional guarantee that every page will always be available, complete, or suitable for every purpose.
Product decisions and institutional commitments should be based on a demonstration, requirements discussion, and the final written agreement rather than the public website alone.
Limitation of liability
To the extent permitted by applicable law, EvalTrack should not be liable for indirect or consequential loss arising solely from access to, inability to access, or reliance on this informational website. Nothing in the final terms should exclude liability that cannot lawfully be excluded. This clause requires jurisdiction-specific legal review before production use.
Changes to the website or terms
EvalTrack may update the website and these terms as the product and institutional offering develop. A production version should show its effective date. Continued use after an update will be governed by the version then shown, subject to applicable law.
